지하수 이용 및 관리에 관한 법체계 연구

우리나라 지하수 이용체계는 민법 상 토지소유권에 기반한 용수권 구조와 지하수법 상 자원 관리체계가 병존하면서 권리의 귀속, 이용 경합 시 우선순 위 등에 관한 기준이 명확하게 정립되지 못한 상태이다. 이는 기후변화와 가뭄 대응, 국가 물 안보 차원에서 점차 중요도가 높아지는 지하수를 효율적으로 보 존하고 관리하는데 제약으로 작용한다. 이러한 현황을 분석하고 지하수법제의 개선방향을 모색하기 위해서는 지하수가 어떠한 자연적·사회적 특성을 갖고 있 으며, 우리나라 수자원 체계에서 어떠한 기능을 수행하는지 살펴볼 필요가 있 다. 이에 본 논문은 우선 자연 상태에서의 지하수의 개념과 함께 우리나라의 수자원 현황과 지하수 개발·이용 실태를 살펴보았다. 이를 통해 제도적 관점과 달리 수문학상 지하수는 토지와 구분되며, 우리나라 일부 지역에서는 상당한 이용 압력과 수량 감소, 수질오염 문제가 발생하고 있음을 확인하였다. 이어서 ‘물을 이용하는 권리’를 의미하는 수리권의 개념과 우리나라 수리권 체계를 검 토하였다. 우리나라의 수리권은 민법 상 공유하천용수권과 관행수리권, 그리고 하천법 및 지하수법 상의 허가수리권 체계가 혼재된 구조를 가지고 있으며, 그 법적 성질에 대해서도 학설이 대립하고 있다. 이처럼 수리권 체계의 불명확 성은 지하수 이용관계에서도 권리 충돌과 법적 불확실성을 초래할 수 있어, 현 대적인 물 관리 체계와의 조화로운 정립이 필요하다. 다음으로 지하수에 대한 민법적 권리구조를 중심으로 토지소유권과 지하수 용수권의 관계를 중점적으로 검토하였다. 민법 제212조는 ‘정당한 이익 있는 범위’에 따라 토지소유자의 권리를 인정한다. 그러나 지하수가 토지의 일부인지 또는 토지소유권의 범위가 미치는 지하수 이용 권리의 한계가 어디까지인지에 대한 명확한 기준은 부재하다. 또한 민법 제235조와 제236조는 상린관계에 근거한 지하수 용수권을 보호하면서도 그 성립이나 권리의 내용에 대해서는 밝 히고 있지 않다. 이렇게 지하수에 관한 법률관계를 규율하는 민법 의 조항이 제한적이므로 민법 상 용수권간의 충돌 내지 다른 권원에 따른 지하수 이용 권리와 충돌 시 이를 규율하기 위한 근거가 부족하다. 지하수는 일정 범위에서 토지와 밀접한 관련을 가지는 자원이지만, 현대 사회에서 지하수가 갖는 공공 성을 고려할 때, 지하수 이용 권리를 민법 해석에 의존하는 것은 효율적 자원 관리와 배분에 한계를 갖는다. 한편, 지하수법 은 지하수를 공공자원으로 선언 하면서 개발·이용에 대해 허가제를 채택하는 등 지하수의 공적 관리에 그 의의 가 크다. 그러나 지하수 관련 기본법으로서 위상을 제고하고 지하수의 보호와 관리의 실효성 측면에서 개선의 필요성이 있음을 확인하였다. 또한 온천법 , 먹는물관리법 , 제주특별법 등 관계 법령은 전체적인 지하수관리 제도의 정합 성 측면에서 일정부분 제약으로 작용하고 있어 이의 개선도 필요하다. 각국의 지하수 법제의 분석을 위하여 일본·스위스·미국의 지하수 이용체계 를 검토하였다. 일본은 국가차원의 지하수법이 부재하는 가운데 지방자치단체 를 중심으로 한 관리체계를 통해 지하수를 공공자원으로서 관리하고 있다. 스 위스는 연방 민법이 지하수가 토지소유권에 부종하는 것으로 명시하고 있음에 도 수력개발의 중요성 등으로 사유로 지하수에 대한 공공관리 법제가 정착하였 다. 최근에는 신기술의 발전에 따라 지하수열의 개발에 따른 법적 쟁점이 부각 되고 있다. 한편, 미국 캘리포니아의 ‘지속가능한 지하수관리법(Sustainable Groundwater Management Act; SGMA)’은 세계적으로 주목받는 선진적 지하 수 법제이다. SGMA는 지속가능성 목표를 설정하고, 모니터링 체계 등을 기반 으로 지하수를 정량적으로 관리한다. 다만 SGMA이전에 토지소유권에 근거한 지하수 이용 권리와의 충돌을 해결해야하는 법적 불안정성을 과제로 갖고 있 다. 이러한 비교법적 검토는 우리나라의 지하수법제 역시 토지소유권과의 명확 한 관계정립이 필수적이며, 지하수의 지속가능성을 위해 과학적 근거에 기반 한 통합적 관리체계를 구축할 필요가 있음을 시사한다. 이러한 검토를 바탕으로 본 논문은 지하수 이용체계의 개선방향을 제시하였 다. 우선 민법 과 지하수법 의 적용 경계를 명확히 하여 민법 상 용수권은 생활용·소규모 이용 범위에 한정하고, 그 이상의 개발과 인공적 취수는 지하 수법 중심으로 규율할 필요가 있다. 또한 지하수 이용권의 귀속 구조와 관련 하여 사유·국유·공유 개념을 검토하고, 지하수의 공공성과 토지소유권을 조화시 킬 수 있는 개선이 필요하다. 나아가 지하수법 이 수질과 수량을 통합적으로 관리하는 기본법으로서 기능할 수 있도록 안전취수량 등 정량적 관리기준과 정 보기반 규제체계를 구축할 필요가 있다. 또한 수리권 체계를 정비하고 이용 경 합 시 우선순위 원칙을 제도화하여, 기존 이용자 보호와 공익, 환경보전 및 지 속가능성을 종합적으로 고려한 조정체계를 마련할 필요가 있다. 주제어 : 지하수, 지하수이용 권리, 일본 지하수법제, 스위스 지하수법제, 미국 캘리포니아 지속가능 수자원법(SGMA), 지하수 배분원칙

Groundwater is increasingly recognized as an essential resource not only for domestic, agricultural, and industrial uses but also for climate change adaptation, drought response, and national water security. As water scarcity and extreme climate events intensify, both groundwater utilization and social dependence on groundwater continue to grow. However, Korea’s groundwater governance system is characterized by the coexistence of groundwater rights derived from land ownership under the Civil Act and public regulation under the Groundwater Act. Consequently, the attribution, legal nature, and priority of groundwater use rights remain unclear. This study first examines the scientific characteristics of groundwater and reviews Korea’s groundwater development and utilization. The findings indicate that some regions are experiencing increasing pressure on groundwater resources, including declining groundwater levels and water quality degradation. The study then analyzes the concept of water rights and Korea’s water rights system, which combines civil-law water rights, customary rights, and permit systems under the River Act and the Groundwater Act. Because the legal nature of water rights remains disputed, legal uncertainty and conflicts in groundwater use continue to arise. The relationship between land ownership and groundwater rights is also examined. Although Article 212 of the Civil Act limits land ownership to the extent of a “legitimate interest,” no clear standard exists regarding ownership of groundwater. While groundwater is closely related to land, its public character and broader social impacts make it inappropriate to regard it as an object of unlimited private control. Water rights under Articles 235 and 236 of the Civil Act may be recognized for naturally occurring groundwater and small-scale uses, but large-scale extraction and artificial development should be governed primarily through public-law regulatory systems. The study further analyzes groundwater use rights under the Groundwater Act. Although the Act declares groundwater to be a public resource and adopts a permit system, the legal nature of groundwater use rights remains controversial. In addition, statutes such as the Hot Spring Act, the Drinking Water Management Act, and the Jeju Special Self-Governing Province Act establish separate regulatory regimes, limiting the Groundwater Act’s ability to function as an integrated groundwater management framework. Therefore, strengthening its role as a framework law is necessary. For comparative analysis, the study examines groundwater governance in Japan, Switzerland, and California. Japan manages groundwater largely through local government regulation, while Switzerland recognizes groundwater as appurtenant to land ownership but has developed extensive public management systems. California’s Sustainable Groundwater Management Act (SGMA) introduces sustainability goals and quantitative groundwater management based on monitoring and planning, although conflicts with preexisting groundwater rights remain. These experiences demonstrate the importance of clarifying the relationship between land ownership and groundwater rights while establishing scientifically based and integrated groundwater management. Based on these findings, this study proposes several reforms. The boundary between the Civil Act and the Groundwater Act should be clarified by limiting civil-law groundwater rights to small-scale and domestic uses while regulating larger-scale extraction under the Groundwater Act. New legal structures should be developed to reconcile land ownership with the public character of groundwater, and rights relating to artificially developed groundwater should be addressed separately. Furthermore, the Groundwater Act should evolve into a framework statute capable of integrating groundwater quantity and quality management through quantitative standards, such as sustainable yield, and information-based regulatory mechanisms. Finally, priority rules for competing groundwater uses should be institutionalized to balance existing users’ interests, public welfare, environmental protection, and long-termsustainability.
